1. Introduction and acceptance

These Terms and Conditions (the "Terms") govern access to and use of the website https://skalepix.com and the SaaS platform operated under the SkalePixbrand (the "Service"). By creating an account, subscribing, or otherwise accessing the Service, you confirm that you have read, understood, and agreed to these Terms, together with our Privacy Policy, Acceptable Use Policy, Cookie Policy, and Refund Policy.

2. Operating legal entity

The Service is operated by Dropdata SpA, registered office at Av. Providencia 1208, Oficina 1503, Santiago, Región Metropolitana 7500000, Chile. Any reference to "we", "our", or "SkalePix" in these Terms is a reference to that entity.

3. Eligibility and accounts

You must be at least 16 years old and have the legal capacity to enter into a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised access.

4. Merchant of Record (Paddle)

Purchases and subscriptions are processed through Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. Paddle handles billing, invoicing, applicable taxes, payment-related enquiries, and refund processing. By completing a purchase, you also agree to Paddle's Checkout Buyer Terms and Privacy Policy.

5. Description of the Service

SkalePix is a SaaS platform that generates marketing assets (product images, ads, social posts, landing pages, and descriptions) using third-party artificial intelligence models. The Service operates on a credit system: each generation consumes a defined number of credits against your active plan.

6. Plans, billing and auto-renewal

  • Subscriptions are billed in advance on monthly or annual cycles, depending on the plan you choose.
  • Subscriptions renew automatically at the end of each cycle unless cancelled from your account dashboard at least 24 hours before renewal.
  • Unused credits do not roll over to the next cycle unless your plan expressly states otherwise.
  • We may change pricing with at least 30 days' prior notice. Changes apply to the next billing cycle.
  • Taxes (VAT, GST, sales tax) are calculated and collected by Paddle according to your jurisdiction.

7. Refunds

We offer a 14-day money-back guarantee subject to the terms in our Refund Policy. Refunds are executed by Paddle.

8. Acceptable use

You agree to use the Service in compliance with our Acceptable Use Policy (AUP). It is prohibited, among other things, to generate illegal, fraudulent, defamatory content, content that infringes third-party rights, involves minors, or is used for disinformation, impersonation, or mass spam. Breaches may result in immediate suspension without refund.

9. AI-generated content — important notices

  • Outputs produced by AI models are probabilistic and may contain inaccuracies, bias, or errors. Review every output before using it in production.
  • We do not warrant that generated content is unique, non-infringing, or fit for any particular purpose.
  • You are responsible for owning or licensing the rights to any image or material you upload as reference.
  • Do not present AI-generated content as human-made when the applicable law or destination platform requires disclosure.

10. Intellectual property

The Service, including its code, brand, UI, algorithms, and documentation, is the exclusive property of Dropdata SpA and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

11. Your content and licence

You retain ownership of the images, URLs, text, and materials you upload ("User Content"). You grant us a worldwide, non-exclusive, limited licence to host, process, and transmit that content solely for the purpose of providing the Service to you. Subject to payment of your active plan, the content generated by you using the Service is yours, provided you hold valid rights to the inputs you supplied.

12. Suspension and termination

We may suspend or terminate your account, with or without notice, if (i) you breach these Terms or the AUP, (ii) your usage endangers the security or integrity of the Service, or (iii) we receive a lawful order from a competent authority. You may close your account at any time from the dashboard or by writing to admin@skalepix.com.

13. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.

14. Limitation of liability

To the maximum extent permitted by law, Dropdata SpA shall not be liable for indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim related to the Service is limited to the amount actually paid by you in the 3 months preceding the event giving rise to the claim.

15. Indemnification

You agree to indemnify and hold Dropdata SpA, its directors, employees, and affiliates harmless against any claim, damage, or cost (including reasonable legal fees) arising from (i) your use of the Service, (ii) your User Content, or (iii) your breach of these Terms.

16. Changes to these Terms

We may update these Terms at any time. Material changes will be notified by email or in-app at least 15 days before they take effect. Continued use of the Service constitutes acceptance of the updated Terms.

17. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of England and Wales, except where mandatory consumer protection rules of your place of residence provide otherwise.
